1. Acceptance of These Terms
These Terms of Service govern access to and use of HighmereHQ websites, applications, communication tools, software, artificial-intelligence-assisted features, and related services.
By accessing or using HighmereHQ, creating an account, accepting an order form, or otherwise indicating acceptance, you agree to these Terms. If you use HighmereHQ on behalf of a company or other organization, you represent that you have authority to bind that organization.
Do not access or use HighmereHQ if you do not agree to these Terms.
2. HIGHMEREHQ Services
HighmereHQ provides software intended to support front-office operations for businesses. Features may include call handling, customer-record creation, conversation transcription and summaries, appointment scheduling, messaging, workflow automation, follow-up management, notifications, operational monitoring, and integrations.
Available features may differ depending on the customer’s subscription plan, configuration, connected services, location, and applicable telecommunications requirements.
HighmereHQ may improve, modify, replace, suspend, or discontinue features when reasonably necessary to maintain security, reliability, compliance, or product performance.
3. Accounts and Authorized Users
You must provide accurate, complete, and current account information. You are responsible for maintaining the confidentiality of login credentials and for activity performed through your account.
You may allow authorized personnel to access HighmereHQ on your behalf. You are responsible for those users, their permissions, and their compliance with these Terms.
You must notify HighmereHQ promptly if you suspect unauthorized access, credential compromise, or another security incident.
4. Business Customer Responsibilities
Businesses using HighmereHQ remain responsible for their services, customers, employees, contractors, business decisions, pricing, scheduling policies, service areas, legal obligations, and regulatory compliance.
You are responsible for configuring business rules, office hours, escalation procedures, emergency instructions, appointment availability, messaging preferences, and connected systems accurately.
You must not represent HighmereHQ-generated information as professional legal, medical, financial, engineering, safety, or emergency advice.
5. AI-Assisted Features and Human Oversight
HighmereHQ may use artificial intelligence to support conversations, summaries, classifications, recommendations, scheduling, routing, and workflow automation.
AI-generated output may occasionally be incomplete, delayed, or inaccurate. Businesses should review important information and maintain appropriate human oversight for sensitive, unusual, urgent, or high-impact matters.
HighmereHQ does not guarantee that AI-assisted features will identify every emergency, complaint, legal concern, scheduling conflict, or customer need.
6. Emergencies and High-Risk Use
HighmereHQ is not an emergency-response service and must not be used as a replacement for 911, emergency dispatch, medical professionals, law enforcement, fire services, or other emergency resources.
Businesses are responsible for maintaining appropriate emergency instructions, escalation contacts, backup procedures, and human coverage.
7. Calls, Text Messages, and Other Communications
HighmereHQ may support telephone calls, text messages, email, voicemail, appointment notifications, reminders, follow-ups, and related business communications.
You are responsible for using these communication features in accordance with applicable consent, privacy, recording, telecommunications, marketing, and consumer-protection laws.
Website-based SMS consent
A customer using the public Request Service page may voluntarily opt in to service-related SMS messages by actively selecting a separate checkbox next to the messaging disclosure. The checkbox is unchecked by default and is not bundled with acceptance of these Terms or the Privacy Policy.
SMS consent is optional. A customer may submit a service request without checking the SMS box, and consent is not a condition of purchase or service.
Informational and transactional text-message communications may include updates about a requested service, appointment scheduling, appointment confirmations, appointment reminders, scheduling or cancellation updates, technician arrival updates, service updates, customer support, and customer-requested follow-up information.
Message frequency varies. Message and data rates may apply. Recipients may reply STOP to opt out or HELP for help. HighmereHQ will honor supported opt-out requests, and future messages may be limited to legally permitted confirmation or administrative notices.
The customer’s mobile number, SMS opt-in information, and consent records will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Providers used solely to operate the messaging program may process information only to perform services for HighmereHQ.

8. Acceptable Use
You may not use HIGHMEREHQ to:
- Violate any applicable law, regulation, court order, or third-party right.
- Send unlawful, deceptive, abusive, harassing, or unauthorized communications.
- Impersonate another person or misrepresent your identity or authority.
- Transmit malicious code or attempt unauthorized access to systems or data.
- Interfere with HIGHMEREHQ security, availability, performance, or monitoring.
- Reverse engineer or misuse HIGHMEREHQ except where expressly permitted by law.
- Use HIGHMEREHQ for emergency dispatch or other prohibited high-risk activities.
HighmereHQ may restrict or suspend access when reasonably necessary to address suspected abuse, fraud, security risks, legal violations, or threats to the platform.
9. Customer Data
You retain your rights in information submitted to HighmereHQ by or for your business, including customer records, call information, transcripts, appointment details, and workflow data.
You authorize HighmereHQ to process this information as necessary to provide, secure, maintain, troubleshoot, and improve the services and to comply with applicable law.
You represent that you have the necessary rights, permissions, and lawful basis to provide and process customer data through HighmereHQ.
10. Privacy
HighmereHQ’s collection and use of personal information is described in the Privacy Policy.
Mobile phone numbers, SMS opt-in information, and text-message consent records will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. SMS consent is optional and is not a condition of purchase or of submitting a service request.
11. Third-Party Services and Integrations
HighmereHQ may connect with telecommunications providers, artificial intelligence providers, calendar services, customer-management platforms, payment providers, cloud services, and other third-party products.
Third-party services are governed by their own terms and policies. HighmereHQ is not responsible for third-party outages, changes, suspensions, inaccuracies, or security practices outside HighmereHQ’s reasonable control.
12. Fees, Billing, and Taxes
Paid services are billed according to the applicable subscription, order form, service agreement, or pricing displayed at purchase.
Unless otherwise stated, fees are exclusive of taxes, telecommunications charges, usage charges, carrier fees, and third-party costs. You are responsible for applicable taxes and authorized usage associated with your account.
Recurring subscriptions may renew automatically until canceled in accordance with the applicable agreement or account settings.
13. Availability, Changes, and Support
HighmereHQ works to provide reliable service but does not guarantee uninterrupted or error-free availability. Maintenance, provider outages, network conditions, software failures, security events, and circumstances outside HighmereHQ’s control may affect service.
HighmereHQ may use backup processes, queued workflows, retries, and other resilience measures, but these measures do not eliminate every risk of delay, interruption, duplication, or loss.

14. Intellectual Property
HighmereHQ and its licensors retain all rights in the platform, software, designs, branding, documentation, models, workflows, and related technology, excluding customer data.
Subject to these Terms and payment of applicable fees, HighmereHQ grants you a limited, non-exclusive, non-transferable, revocable right to use the services for your internal business operations.
15. Feedback
You may provide suggestions or feedback about HighmereHQ. You grant HighmereHQ permission to use that feedback without restriction or compensation, provided HighmereHQ does not publicly identify you as the source without permission.
16. Suspension and Termination
HighmereHQ may suspend or terminate access when reasonably necessary because of nonpayment, violation of these Terms, unlawful conduct, security risk, misuse, fraud, provider restrictions, or risk to customers or the platform.
You may stop using HighmereHQ and cancel eligible subscriptions according to your service agreement or account settings.
Provisions that by their nature should survive termination will remain effective, including provisions concerning payment obligations, intellectual property, disclaimers, liability, indemnification, and disputes.
17. Disclaimers
To the fullest extent permitted by law, HighmereHQ is provided on an “as is” and “as available” basis.
HighmereHQ disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, uninterrupted availability, and results that may arise from use of the services.
HighmereHQ does not guarantee that every call, message, appointment, transcription, summary, escalation, integration, or automated workflow will be completed accurately or successfully.
18. Limitation of Liability
To the fullest extent permitted by law, HighmereHQ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, data, or opportunities.
To the fullest extent permitted by law, HighmereHQ’s total aggregate liability arising from the services will not exceed the amount paid by the customer to HighmereHQ during the six months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply.
19. Indemnification
You agree to defend, indemnify, and hold harmless HighmereHQ and its officers, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising from your customer services, customer data, communications, violation of law, misuse of HighmereHQ, or breach of these Terms.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before filing a formal claim, each party agrees to make a reasonable effort to resolve the dispute informally by providing written notice describing the issue and requested resolution.
21. Changes to These Terms
HighmereHQ may update these Terms periodically. The updated version will be posted on this page with a revised effective date. Continued use of HighmereHQ after an update becomes effective constitutes acceptance of the revised Terms where permitted by law.
22. General Terms
These Terms, together with applicable order forms, service agreements, and incorporated policies, constitute the agreement between you and HighmereHQ concerning the services.
If a provision is unenforceable, it will be modified only to the extent necessary, and the remaining provisions will remain in effect.
Failure to enforce a provision is not a waiver. You may not assign these Terms without HighmereHQ’s written consent. HighmereHQ may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets.
